INFORMATION
ON THE PROTECTION OF INDIVIDUALS WITH REGARD
TO THE PROCESSING OF PERSONAL DATA
SIF Oltenia SA pays particular attention to the processing of personal data of natural persons (individual shareholders or representatives of legal entities, employees or collaborators with whom they come into contact in the current activity). In this respect, the compliance with the provisions of EU Regulation 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Directive) is our company's priority.
Definitions:
- personal data - any information about an identified (or identifiable) individual (the "targeted person");
- targeted person - an identifiable individual is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as: a name, an identification number, location data, an online identifier, or one or more specific elements, according to its physical, physiological, genetic, psychic, economic, cultural or social identity;
- processing - any operation or set of operations performed on personal data or personal data sets, with or without the use of automated means such as collecting, recording, organizing, structuring, storing, adapting or modifying, extracting, consulting, use, disclosure or transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
- consent - (of the targeted person) - any free, specific, informed and unambiguous manifestation of will from the targeted person, through which it accepts, through a statement or unequivocal action, that the personal data concerning it are processed;
- personal data operator - SIF Oltenia SA, based in Craiova Municipality, Tufanele Street, no. 1, Dolj County.
In order to keep personal data in complete safety and to process them only for the purposes permitted by the legal provisions or by their holders, SIF Oltenia SA undertakes to apply appropriate technical and organizational measures for the protection of personal data of individuals against accidental or illegal destruction, loss, modification, disclosure or unauthorized access, especially if the processing involves data transmission within a network, as well as against any form of illegal processing.
Therefore, SIF Oltenia SA, in the desire to always be transparent with the shareholders, employees and its collaborators, undertakes to manage the personal data provided by the individual shareholders, the representatives of the legal entities, the employees, the collaborators or other natural persons whose activity interact with SIF Oltenia SA, in safe conditions and only in order to achieve specific goals.
Purpose of processing personal data
SIF Oltenia SA processes the personal data of its shareholders in order to keep their records, for calculating the amounts to be paid in the form of dividends, and to keep the contact data in the event of correspondence with them (sending of special mandates or voting bulletins, answering questions, etc.).
Also, the personal data of the shareholders are required to be communicated to regulatory authorities, public authorities, contractual partners (dividend payment agents), judicial authorities and criminal investigation and prosecution bodies, under the regulatory framework.
In the case of employees and collaborators, natural persons, or representatives of legal entities, the personal data is necessary for the conclusion of employment contracts, respectively of collaboration agreements, under the law.
In order to achieve the stated purposes, the individual shareholders or the representatives of legal entities, employees or collaborators will send SIF Oltenia SA the requested personal data.
Rights of the targeted persons
In accordance with the provisions of EU Regulation 679/2016, the targeted persons have the following rights:
- Right of access - the targeted person has the right to obtain from SIF Oltenia SA a confirmation that the personal data concerning him / her are processed or not and, if so, he / she has access to that data;
- Right to rectification (right of intervention) on the data - the targeted person has the right to obtain from SIF Oltenia SA, without undue delay, the rectification of inaccurate personal data concerning him / her;
- Right to delete the data ("the right to be forgotten") - the targeted person has the right to obtain from SIF Oltenia SA the deletion of personal data concerning him / her, without undue delay;
- The right to restrict the processing - the targeted person has the right to obtain from SIF Oltenia SA the restriction of the processing when he / she contests the accuracy of the data, the lawfulness of the processing;
- The right to data portability - the targeted person has the right to receive the personal data belonging to him / her, and which he / she has provided to the operator, in a structured format that is currently used and which can be read automatically, and he / she is entitled to transmit this data to another operator;
- The right to opposition - the targeted person has the right, for reasons connected with the particular situation in which he or she is concerned, to oppose to the processing of personal data concerning him / her;
- The automated decision-making process - the targeted person has the right not to be the subject of a decision based exclusively on automatic processing and profile creation, which produces legal effects which concern him / her;
- The right to lodge a complaint with the competent authority.
The publication of personal data of individuals on the company's website and the use of personal data by employees of the company who had access to such data in the exercise of their job duties or to which they had accidentally access can be made only if the rights and fundamental freedoms of those persons are not violated and the applicable legal provisions are observed.
In the event of changes in the incumbent normative acts or in the organization and functioning of the company, SIF Oltenia SA undertakes to adapt the procedure regarding the processing of personal data of individuals and to make public the changes made.
